PARENTAL RELOCATION

New York law requires a custodial parent to get court approval to relocate with a child.

The court will decide if the move is in the child's best interests, and will consider many factors, including:

  • The reasons for the move

  • The quality of the child's relationship with each parent

  • The child's safety and the safety of each parent from abuse

  • The child's education

  • The stability of the new home environment

  • The effect on visitation

  • The effect on extended family relationships
